Communication relating to BRUO 2006
For the sake of transparency, Belgacom informs the market that it introduced a claim before the Court of Appeal of Brussels requesting that the BIPT decision of November 9, 2005 relating to the BRUO 2006 is declared void, particularly but not exclusively on the following aspects : the tariffs, the ISLA conditions, the free inquiry, the obligations with regard to the offering of migration services, the damageable processes imposed by the BIPT, etc.

Accordingly, while the BRUO 2006 has been adapted in good faith in accordance with the BIPT decision of November 9, 2005, Belgacom reserves the right either to claim damages or to apply retroactively the tariffs and conditions included in its BRUO 2006 initial offer published on this website (see below) to the present communication in the event that the recourse would be succesful. Relating to specific services, Belgacom reserves the right to conclude in good faith specific agreements at reasonable service and pricing conditions with Beneficiaries requesting specific processes (e.g. for the synchronisation of various services offers such as number portability with migration services, etc.).

What is expressed above worths also as regards the appeals introduced by Belgacom against the subsequent decisions of the IBPT relating to particular points of the BRUO offer. Concerning these appeals and the consequences of a possible cancellation of the aimed decisions, it is sent back to the addenda and the communications or informations of these addenda by which Belgacom proceeded to the integration of these modifications.

Communication relating to BRUO - Unofficial version coordinated by Belgacom
This coordinated version is the result of an unofficial coordination of the BRUO 2006 offer and its subsequent addenda as approved by the BIPT which documents altogether remain the sole official version of BRUO. This unofficial version of BRUO is published by Belgacom for sake of increasing readability. In case of contradiction between the version of BRUO including its addenda as approved by the BIPT and this unofficial coordinated version, the version of BRUO including its addenda approved by the BIPT shall prevail.

Belgacom reminds that several appeal proceedings were introduced by Belgacom before the Court of Appeal against some of the BIPT decisions related to BRUO. This unofficial version of BRUO is published by Belgacom without any adverse recognition and without prejudice to Belgacom interests. It shall under no circumstances be considered as a waiver by Belgacom of its rights and interests in the concerned appeal proceedings.
