Conditions for delivering DSL services using Belgacom's network.
Communication relating to BROBA 2008
Belgacom proceeds to the publication on its website of Belgacom Reference Bitstream Access Offer ("BROBA") 2008 offer initially submitted by Belgacom to the BIPT as well as BROBA 2008 offer as approved by BIPT on 28/04/2008. For the sake of transparancy, in order to take into account the different new processes, prices and services successively integrated to BROBA services since the beginning of 2008, Belgacom also publishes edited versions of the offer approved by BIPT incorporating the modifications resulting from BIPT decisions dated 4, 11 and 25 June, 20 August and 22 October 2008.
Notwithstanding the above, Belgacom introduced a claim at the Court of Appeal in Brussels with regard to the forecasting system and SLA conditions imposed by BIPT in its decision of 21 November 2007. In the event that this action would be succesful and that the modifications brought by the BIPT would be declared void, and subject to any other consideration, Belgacom reserves the rights to claim damages or to apply retroactively its BROBA 2008 initial offer, including the tariffs, published on Belgacom website.
Relating to specific services and notwithstanding any diverging decision of the BIPT on the BROBA, Belgacom reserves the right not to provide the services without prior conclusion of specific agreements negotiated in good faith at reasonable service and pricing conditions with Beneficiaries requesting specific processes.
